The Family Educational Rights and Privacy Act (FERPA) (20 U.S.C. § 1232g; 34 CFR Part 99) is a Federal law that protects the privacy of student education records. FERPA establishes guidelines for the disclosure of student education records, and applies to all educational institutions that receive some form of funding from the U.S. Department of Education.
Release of Data to Third-Parties
Under certain conditions, FERPA specifies that a third-party may be considered a “school official with a legitimate educational interest,” and thus permitted to receive educational records and personally identifiable information. Disclosure to a third-party is permitted under the following conditions:
- The third-party must perform institutional services for which the institution would otherwise use employees;
- The third-party must remain under the direct control of the institution with respect to the use and maintenance of education records; and
- The third-party must adhere to the FERPA requirements governing the use and redisclosure of personally identifiable information from education records.
FERPA and SmartEvals Users
SmartEvals complies with the Third-Party criteria set forth by FERPA. SmartEvals users may therefore disclose educational records and personally identifiable information to GAP in the course of carrying out legitimate educational interests. Any data received by GAP remains under the control of the client institution and is kept strictly confidential—it is never re-disclosed to other parties, and is protected by stringent security policies.
For purposes of the Annual Notification of FERPA Rights, the client institution should include GAP Technologies Inc. in its definitions of the terms "school official" and "legitimate educational interest."
